1. Acceptance of Terms
By accessing or using the services of Lexato Tecnologia Ltda. ("Lexato"), you agree to comply with and be bound by these Terms of Use. If you do not agree with any part of these terms, you may not access or use our services.
2. Description of Services
Lexato offers digital evidence certification services, including:
- Capture of screenshots and videos of web pages
- Generation of cryptographic hashes (SHA-256)
- Blockchain registration (Polygon and Arbitrum)
- ICP-Brasil timestamp acquisition
- Generation of certificates and PDF reports
- Public authenticity verification
- Evidence storage
3. Registration and Account
To use our services, you must:
- Be at least 18 years old
- Provide truthful and complete information
- Keep your access credentials confidential
- Set up multi-factor authentication (MFA)
- Immediately notify us of any unauthorized use
You are responsible for all activities performed under your account.
4. Acceptable Use
You agree to:
- Use the services only for lawful purposes
- Not violate the rights of third parties
- Not capture illegal or harmful content
- Not attempt to circumvent security measures
- Not overload our systems
- Not resell or redistribute the services
5. Credits and Payments
- Services are prepaid through credits
- Each certification consumes 1 credit
- Unused credits do not expire
- Prices may be changed with 30 days prior notice
- Payments are processed by InfinitePay
- Refunds for unused credits may be requested within 7 days
6. Evidence Storage
- Standard storage: Files available for 90 days
- Premium storage: 5, 10, or 20 years (with additional payment)
- Metadata and hashes: Stored indefinitely
- Blockchain records: Permanent and immutable
After storage expiration, files are deleted, but authenticity verification continues to work through metadata and hashes.
7. Intellectual Property
Lexato holds all rights to the platform, software, brand, and original content. You retain ownership of the evidence you capture. By using our services, you grant us a limited license to process and store your evidence as necessary to provide the services.
8. Limitation of Liability
Lexato is not responsible for:
- Content of captured pages
- Use of evidence in legal proceedings
- Court decisions based on the evidence
- Temporary unavailability of services
- Indirect or consequential damages
Our maximum liability is limited to the amount paid for services in the last 12 months.
9. Warranties
Lexato warrants that:
- Hashes are correctly generated using the SHA-256 algorithm
- Blockchain records are made on the Polygon and Arbitrum networks
- Timestamps are obtained from ICP-Brasil Certification Authorities
- Data is stored securely
We do not guarantee that evidence will be accepted in all legal proceedings, as this depends on the judge's analysis.
10. Suspension and Termination
We may suspend or terminate your account if you:
- Violate these Terms of Use
- Use the services for illegal purposes
- Fail to pay for services used
- Provide false information
You may terminate your account at any time. After termination, your data will be handled in accordance with our Privacy Policy.
11. Changes to Terms
We may modify these terms at any time. Significant changes will be communicated by email or notice on the website with a minimum of 30 days advance notice. Continued use of the services after changes constitutes acceptance of the new terms.
12. Applicable Law and Jurisdiction
These terms are governed by the laws of the Federative Republic of Brazil. The courts of São Paulo - SP are elected to resolve any disputes, with waiver of any other, however privileged it may be.
